QuizLanding Terms of Service

These terms are an agreement between Lusson LLC, 30 N Gould St, Sheridan, WY 82801, USA ("we", "us") and the merchant installing the QuizLanding app from the Shopify App Store ("you"). Installing or using the app means you accept them.

1. The service

QuizLanding lets you build quiz funnels on your Shopify store, capture leads, and sync them to your Shopify customer list, with optional AI-assisted quiz generation and analytics. We may improve or change features over time; we won't materially reduce what a paid plan includes without notice.

2. Accounts and billing

Access runs through your Shopify account. Fees are charged through Shopify's billing system on the plan you select in the app; Shopify's refund mechanics apply. You can cancel anytime by uninstalling the app or downgrading your plan.

3. Your responsibilities

• You own your store, your quiz content, and your relationship with your customers. You are the data controller for shopper data captured by your quizzes; we process it on your behalf.
• You are responsible for configuring marketing opt-in lawfully for your market. The app supports an explicit consent checkbox (default), a subscribe-everyone mode, and capture-only. If you use subscribe-everyone, it is your responsibility to ensure that complies with the laws that apply to your customers (e.g. GDPR, CAN-SPAM, CASL) and that your quiz says so.
• You will not use the app to collect data you have no right to collect, to send spam, or for anything unlawful or deceptive.
• You are responsible for your own privacy policy and disclosures to your shoppers.

4. Data processing

For personal data of your shoppers, the following terms apply (this section is our data processing agreement):

• Scope. We process the data described in our Privacy Policy — quiz answers, typed input values (email, name, phone, other fields you add), and consent records — solely to provide the service to you, on your documented instructions (your quiz configuration).
• Confidentiality and security. Data is encrypted in transit and at rest; access is restricted to personnel who need it, protected by strong authentication. Integration API keys you provide are additionally encrypted at the application level.
• Sub-processors. We use the infrastructure providers listed in the Privacy Policy. We remain responsible for their handling of your data and will update the list before adding new sub-processors that touch personal data.
• No selling, no secondary use. We never sell your shoppers' data, share it across merchants, or use it to train AI models.
• Deletion. Uninstalling the app triggers deletion of your shop's data via Shopify's erasure webhooks. Customer-level deletion requests received through Shopify are honored automatically. We comply with Shopify's protected customer data requirements.
• Breach notice. If a security incident affects your shoppers' personal data, we will notify you without undue delay after becoming aware, with what we know and what we're doing about it.
• Assistance. We provide reasonable assistance with data subject requests and lawful audits regarding data we process for you.

5. Intellectual property

The app, its code, and its branding are ours. Your quiz content, your data, and your customers are yours. You grant us the limited rights needed to host and display your content to operate the service. Feedback you send us may be used to improve the product.

6. Acceptable use of AI features

AI generation works from content you provide (your products, brand, website). You're responsible for reviewing generated quiz copy before publishing it — it's your storefront and your claims.

7. Availability, warranties, liability

We aim for high availability but the service is provided "as is" — we don't warrant uninterrupted or error-free operation. To the maximum extent permitted by law, our total liability for any claims arising from the service is limited to the fees you paid us in the twelve months before the claim, and we are not liable for indirect or consequential damages. Nothing here limits liability that cannot lawfully be limited.

8. Termination

You can stop anytime by uninstalling. We may suspend or terminate service for breach of these terms, abuse, or legal necessity — with notice where practicable. On termination, your shop's data is deleted per Section 4.

9. Changes and governing law

We may update these terms; material changes are announced to merchants inside the app with reasonable notice, and continued use after that means acceptance. These terms are governed by the laws of the State of Wyoming, USA, with disputes resolved in the courts of Sheridan County, Wyoming.
